I don't think that they can do that. I think that they have to adopt the indentures that the residents signed when they moved in, if there were any. If there weren't any, then the new company cannot impose any. I think that the residents have the upper hand here. As long as many of them are against this, then I don't think that the new company can do what they are trying to do.

I agree with CC. Unless the wording in the covenants and restrictions state that it can be amended, and then the current homeowners need to sign off on it. It sounded like Will was talking about a mobile home park at first.

I believe Windcrest operates like a condominium complex with a maintenance agreement. When the price of services go up they can raise the fees accordingly. It includes other amenities, I'm not sure which ones, but I can check on it.
